BUYABEAT'S ROYALTY FREE MUSIC TERMS AND CONDITIONS

BuyaBeat music may only be used pursuant to the terms and conditions enforced by BuyaBeat.com. By purchasing music licenses sold under BuyaBeat.com, you automatically become bound to the terms of the License Agreement.

BUYABEAT SECURE ID® ENCRYPTION: For the added protection and security of BuyaBEat.com and its Customers, all product files (downloaded or shipped) are encrypted with Customer ID encryption identifying the Customer's IP Address, Name, Date, and Time tied to the Customer's Order. ID Header Tags remain embedded within each audio file regardless of modification or resampling. This technology is possible due to BuyaBeat developing a proprietary system where ID Tag encryption occurs at a binary root level for all audio files, not at traditional text header levels. Secure ID® Customer Privacy and Protection: BuyaBeat guarantees the full privacy and protection of its valued customers. BuyaBeat will never disclose valued customer information to third parties. Perpetrators Beware: Unauthorized use, distribution, or duplication is a violation of applicable laws. With BuyaBeat's Secure ID® Technology, you WILL be caught and prosecuted to the fullest extent of the law.

BUYABEAT'S TERMS AND CONDITIONS ARE AS FOLLOWS:

1. The royalty free non-exclusive musical compositions (NE beats) sold by BuyaBeat remain the property of BuyaBeat and are licensed, not sold, to you the licensee. BuyaBeat offers 2 types of licenses for purchase: Limited License and Business License.

2. BuyaBeat's Limited License grants you (the licensee) the right to use BuyaBeat's royalty-free compositions (NE beats) only for Local Radio/TV Advertisement, Internet Background Music, On-Hold & In-House Background Music, and/or Artist Demonstrations. SPECIFIC LIMITATIONS EXIST where BuyaBeat's music can only be used for non-profit purposes and when used for recording artist demos the artist must adhere to the rules of "synchronization", recording vocals against and over BuyaBeat music. A Business License is required when using BuyaBeat music as part of any commercial (for-profit) product, purpose, or venture.

3. BuyaBeat's Business License grants you (the licensee) all of the rights included in the Limited License PLUS many additional rights. With a Business License, you may download & use BuyaBeat's royalty free NE Beats for commericial (for-profit) purposes that result in end products/services such as DVD Products, Major Motion Films, Independent Films, Television Series Background, Television Series Theme, Sports Television Broadcasts, Gaming Multimedia, Internet Multimedia, Adult Multimedia, Recording Artist Albums, Radio Singles, Radio Rotation, and/or Film/DVD Soundtracks. If you use BuyaBeat's music for any of the purposes listed above, you are required by law to purchase a Business License directly from BuyaBeat.com. All distributed works must show the following legal music credit: Music Producer - ModernBeats Inc.

Failing to obtain the proper legal license from BuyaBeat will only result in hefty copyright infringement fines or possible confinement. NOTE: A single violation of federal copyright laws will cost you a $30,000.00 fine. In other words, be certain you obtain a "Business License" if you plan to use BuyaBeat's music for Record Company ventures, Television Broadcast ventures, Radio Rotation, Television theme music, and the like. If you plan to use recordings of BuyaBeat music for other than demonstration purposes, you are required by law to purchase BuyaBeat's Business License to allow use of BuyaBeat's music for Record Company ventures, Television Broadcast ventures, Film Soundtracks/Scores, and more. All distributed works must show the following legal music credit: Music Producer - ModernBeats Inc.

4. It is specifically understood and agreed that Licensee does not acquire any ownership rights or any underlying copyrights, and that Licensor retains all rights, title and interest in the music obtained from BuyaBeat, including all copyrights belonging to the original copyright holder, as well as any modifications or improvements made to the licensed property by Licensee.

5. The License expressly FORBIDS resale or other distribution of BuyaBeat compositions, either as the exist OR any modification thereof. You CANNOT sell, loan, rent, lease, assign, or transfer all OR any of the products sold under BuyaBeat.com to another user, or for use in any competitive product.

Unauthorized use or duplication is a violation of this agreement and of applicable laws of the United States and other countries. Any infringement of copyright will be pursued to the fullest extent of the law.
